Terms and Conditions

1. Acceptance of Terms

By accessing or using Lakeland Market’s website, products, and services, you agree to be bound by these Terms and Conditions. If you do not agree, you must discontinue use of our website and services immediately.

You must be 18 years or older to place an order.

2. Product Information

Lakeland Market strives to provide accurate product descriptions, imagery, and pricing. However, we do not guarantee that all information is complete, current, or error-free.

All products are subject to availability, and we may modify or discontinue any product without notice.

3. Orders and Payment

All orders are subject to acceptance and availability. Lakeland Market reserves the right to cancel or refuse any order due to limited stock, errors in product or pricing information, or suspected fraudulent activity.

Payment must be successfully processed before any order is prepared or delivered.

Orders cannot be canceled once they have entered the packing or delivery process.

4. Delivery

We currently deliver throughout the Greater Toronto Area (GTA). Deliveries take place every Wednesday and Friday.

4.1 Delivery Cut-Off Times

Orders placed after Tuesday at 6 PM will be delivered on Friday.

Orders placed after Thursday at 6 PM will be delivered the following Wednesday.

Cut-off times may be adjusted during high-volume periods.

4.2 Delivery Completion

Delivery is considered successfully completed when the order is:

  • Handed directly to the customer, or
  • Left at the delivery address provided during checkout.

Once delivery is completed, Lakeland Market is not responsible for lost, stolen, or improperly stored products.

5. Returns and Refunds

5.1 Fresh Oysters (Perishable Items)

Due to the perishable nature of oysters, all sales are final.

However, if you receive oysters that are spoiled, expired, or unsafe to consume, you must report the issue within 24 hours of delivery.

5.2 Proof Required for Oyster Claims

To qualify for a refund or replacement, you must provide:

  • Clear photos of the unopened mesh bag
  • Photos of the packaging label
  • Photos of the affected oysters
  • Proof of purchase

Claims without adequate documentation will not be approved.

Lakeland Market is not responsible for deterioration caused by:

  • Failure to refrigerate immediately after delivery
  • Improper storage at any point after delivery
  • Leaving the package unattended
  • Opening the bag and exposing oysters to improper conditions

Improper storage voids eligibility for any refund or replacement.

5.3 Accessories & Non-Perishable Items

Accessories (shuckers, towels, merch, etc.) may be returned within 30 days, provided that the item:

  • Is unused, undamaged, and in original condition
  • Shows no signs of wear, misuse, or breakage
  • Includes proof of purchase

Return Shipping: Customers are responsible for return shipping costs unless the item arrived defective.

Approved returns will be refunded to the original payment method.

6. Product Storage and Handling

Oysters must be refrigerated at 2–4°C (35–40°F), stored cup-side down, and kept covered with a damp cloth. Do not store oysters in airtight containers or submerge them in fresh water.

Lakeland Market is not responsible for any issues or illness arising from improper storage, handling, transport, or preparation after delivery.

7. Limitation of Liability

To the fullest extent permitted by law, Lakeland Market is not liable for:

  • Indirect, incidental, punitive, or consequential damages
  • Loss of profits, data, use, goodwill, or other intangible losses
  • Illness or injury resulting from improper handling or storage after delivery

If liability is established, it is limited to the amount paid for the product in question.

8. Changes to Terms

Lakeland Market may update or modify these Terms and Conditions at any time. Continued use of our website or services after changes are posted constitutes acceptance of the revised terms.
