These Terms and Conditions ("Terms") govern your access to and use of the Lakeland Market website and services, operated by anbu Corp. doing business as Lakeland Market ("Lakeland Market", "we", "us", or "our").

By accessing or using our website, placing an order, or interacting with our services, you agree to be bound by these Terms and our Privacy Policy (collectively, the "Agreement"). If you do not agree, you must stop using our website and services immediately.

You must be at least the age of majority in your province or territory of residence (and at least 18 years old) to place an order.

1. Use of Website and Services

1.1 Personal, Non-Commercial Use

You may use our website and services for personal, non-commercial purposes only (e.g., browsing, placing orders, leaving reviews). You may not resell our products without our prior written consent.

1.2 Prohibited Uses

You agree not to:

  • Use the website in any way that violates applicable laws or regulations.
  • Attempt to interfere with, disrupt, or overload our systems or network.
  • Use any automated tools (bots, scrapers, spiders) to access or collect data from the website without our permission.
  • Attempt to reverse-engineer, decompile, or otherwise access the source code of our website.
  • Attempt to bypass any security or access controls.

We may suspend or terminate your access to the website or cancel orders if we believe you have violated these Terms.

2. Product Information

2.1 Accuracy

Lakeland Market strives to provide accurate product descriptions, imagery, and pricing. However, we do not guarantee that all information is complete, current, or error-free. Product photos are for illustrative purposes only; actual products may vary in appearance (size, shell colour, shape, etc.). Oysters may not look exactly like the pictures displayed on the website, as each oyster is unique and naturally varies in appearance.

2.2 Natural Product Characteristics

Our oysters are harvested from natural ocean environments and are wild-caught products. As such, oysters may arrive with natural debris, sediment, or organic matter on their shells, including but not limited to: seaweed, marine organisms, sand, dirt, or other naturally occurring materials from their ocean habitat. This is normal and expected for wild-harvested oysters.

Customers are responsible for cleaning and preparing oysters for consumption. If you find debris, sediment, or other natural materials on the shells, it is recommended that you clean the oysters before shucking. However, you must not soak or submerge oysters in fresh water or tap water, as this will kill the oysters and render them unsafe for consumption.

While we strive to provide the highest quality products and take care in handling and packaging, oysters are natural products from the wild. Variations in appearance, shell condition, and the presence of natural debris are inherent characteristics of wild-harvested oysters and do not constitute a defect or grounds for refund. Customers must take their own precautions when cleaning and maintaining the safety of oysters after delivery.

2.3 Availability and Changes

All products are subject to availability. We may modify, temporarily suspend, or discontinue any product or offering at any time without notice. Prices may change without prior notice.

2.4 Allergies and Dietary Considerations

Oysters and shellfish can cause severe allergic reactions in some individuals. It is your responsibility to ensure that you and anyone consuming the products can safely do so. We do not accept liability for allergic reactions or adverse responses related to shellfish or other ingredients.

3. Orders and Payment

3.1 Order Acceptance

Your order is an offer to purchase products from us. We reserve the right, in our sole discretion, to accept or reject any order, in whole or in part, including for reasons such as:

  • Product unavailability
  • Errors in pricing or product information
  • Concerns about payment, fraud, or misuse
  • Violations of these Terms

We will attempt to notify you if your order is cancelled or cannot be fulfilled.

3.2 Payment

Payment must be successfully processed before any order is prepared for packing or delivery. By providing payment information, you confirm that:

  • You are authorized to use the payment method provided; and
  • You authorize us (and our payment processor) to charge the full amount of your order, including taxes, fees, and any applicable delivery charges.

3.3 Pricing Errors

If a product is listed at an incorrect price due to an error, we may cancel any orders placed for that product at the incorrect price, even if the order has been confirmed. In such cases, we will offer a refund or the option to reorder at the correct price.

3.4 Order Changes and Cancellations

Orders cannot be cancelled or modified once they have entered the packing or delivery process. We may, at our discretion, assist with changes requested within our operational time frames, but we are not obligated to do so.

4. Delivery

4.1 Delivery Area

We currently deliver throughout the Greater Toronto Area (GTA). Delivery coverage may change at any time. If your address is outside our service area, we may cancel your order and issue a refund.

4.2 Delivery Days

Standard delivery days are:

  • Wednesday
  • Friday

These days may change during holidays, peak seasons, or due to operational constraints.

4.3 Cut-Off Times

  • Orders for Wednesday delivery must be placed by the previous Saturday at 12:00 PM (noon).
  • Orders for Friday delivery must be placed by the previous Monday at 12:00 PM (noon).

For example, if you wish to have an order delivered on Wednesday, December 31, the order must be placed by Saturday, December 27 at 12:00 PM. Cut-off times may be adjusted during high-volume periods, holidays, or special promotions. Updated times will be communicated on the website when applicable.

4.4 Delivery Completion and Risk of Loss

Delivery is considered successfully completed when the order is:

  • Handed directly to the customer or an individual at the delivery address; or
  • Left at the delivery address provided at checkout (including lobby, concierge, front door, or other reasonable drop-off location, as determined by the driver).

Once delivery is completed:

  • Risk of loss and title to the products pass to you.
  • Lakeland Market is not responsible for lost, stolen, or improperly stored products, including packages left unattended, taken by others, or exposed to unsuitable temperatures.

4.5 Incorrect or Incomplete Addresses

You are responsible for providing accurate delivery information. We are not liable for delays, misdeliveries, or losses resulting from:

  • Incorrect or incomplete addresses;
  • Inaccessible buildings or gated communities; or
  • Failure to receive or retrieve the order in a timely manner.

Additional delivery attempts or corrections may result in extra charges.

4.6 Delays and Force Majeure

We are not responsible for delays caused by events beyond our reasonable control, including but not limited to weather conditions, traffic, courier issues, accidents, labour disputes, or public emergencies.

5. Returns and Refunds

5.1 Fresh Oysters (Perishable Items)

Due to the highly perishable nature of fresh oysters, all sales are final and non-refundable, except where the product arrives spoiled, expired, or unsafe to consume.

If you believe your oysters are not fit for consumption, you must:

  • Report the issue within 24 hours of delivery, and
  • Not discard the product before contacting us (unless necessary for safety reasons).

5.2 Proof Required for Oyster Claims

To qualify for a refund, credit, or replacement (at our discretion), you must provide:

  • Clear photos of the unopened mesh bag(s)
  • Photos of the packaging label (including dates, tags, or identifiers)
  • Photos of the affected oysters
  • Proof of purchase (order number, confirmation email, or receipt)

Claims submitted without adequate documentation, submitted late, or where we cannot reasonably verify the issue may be denied.

5.3 Storage-Related Exclusions

Lakeland Market is not responsible for deterioration or spoilage caused by:

  • Failure to refrigerate oysters immediately after delivery
  • Storing oysters outside recommended temperatures
  • Storing oysters in airtight containers or in fresh water
  • Leaving the package unattended for extended periods
  • Opening the mesh bag and exposing oysters to improper conditions
  • Transporting oysters after delivery without proper cooling

Improper storage or handling voids eligibility for any refund or replacement.

5.4 Accessories & Non-Perishable Items

Accessories and non-perishable items (e.g., shuckers, towels, merch, tools) may be returned within 30 days of delivery, subject to the following conditions:

  • Items must be unused, undamaged, and in original condition
  • No signs of wear, misuse, alteration, or breakage
  • Proof of purchase is provided

Return Shipping: Customers are responsible for return shipping costs unless the item arrived damaged or defective.

Upon approval and receipt/inspection of the returned item, refunds will be processed to the original payment method. We may instead offer a store credit or replacement at our discretion.

6. Product Storage and Handling

You are responsible for storing and handling oysters safely after delivery.

  • Keep oysters refrigerated at 2–4°C (35–40°F).
  • Store them cup-side down.
  • Keep them covered with a damp cloth.
  • Do not store oysters in airtight containers or immerse them in fresh water.
  • You may keep them in the mesh bag provided, placed in a suitable refrigerated environment.

Lakeland Market is not responsible for any illness, injury, or loss resulting from:

  • Improper storage or handling after delivery;
  • Failure to follow safe food handling practices; or
  • Consumption of oysters beyond recommended time frames.

If you are unsure whether an oyster is safe, do not consume it.

7. Intellectual Property

All content on the Lakeland Market website, including but not limited to logos, graphics, photos, text, product descriptions, and design elements, is owned by or licensed to anbu Corp. and protected by applicable intellectual property laws.

You may not:

  • Copy, reproduce, modify, distribute, display, or create derivative works from our content;
  • Use our trademarks, logos, or branding in any way that suggests association, endorsement, or ownership without our prior written consent.

8. User Content (Reviews, Photos, Submissions)

If you submit reviews, photos, testimonials, or other content ("User Content") to us or via our website or social media:

  • You remain the owner of your content; however,
  • You grant Lakeland Market a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, modify, publish, display, distribute, and otherwise exploit that content in any media for marketing, promotional, or operational purposes, without further notice or compensation.

You represent and warrant that:

  • You have the right to submit the User Content;
  • The User Content does not infringe any third-party rights or violate any law;
  • Any identifiable persons in the content have consented to such use.

We may remove or decline to use any User Content at our discretion.

9. Third-Party Services and Links

Our website may contain links to third-party websites, applications, or services (e.g., payment processors, social media platforms). We do not control and are not responsible for:

  • The content, policies, or practices of third-party sites; or
  • Any loss or damage arising from your use of third-party sites.

Your use of third-party websites is subject to their terms and privacy policies.

10. Disclaimer of Warranties

To the fullest extent permitted by law, our website, products, and services are provided on an "as is" and "as available" basis, without any warranties of any kind, whether express, implied, or statutory, including but not limited to:

  • Implied warranties of merchantability;
  • Fitness for a particular purpose;
  • Non-infringement; or
  • Availability, reliability, or error-free operation of the website.

We do not warrant that:

  • The website will always be available, secure, or free of viruses or other harmful components; or
  • Any product will meet your specific expectations in terms of size, appearance, or taste, which may vary naturally.

11. Limitation of Liability

To the fullest extent permitted by law, anbu Corp., Lakeland Market, and our directors, officers, employees, contractors, and agents will not be liable for any:

  • Indirect, incidental, special, consequential, or punitive damages;
  • Loss of profits, revenue, data, or goodwill;
  • Any illness, injury, or damage arising from improper storage, handling, transport, or preparation of products after delivery.

If we are found liable to you, our total liability for any claim arising out of or relating to your use of the website, products, or services is limited to the total amount you paid for the order giving rise to the claim.

Some jurisdictions do not allow certain limitations; in that case, our liability will be limited to the maximum extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless anbu Corp., Lakeland Market, and our directors, officers, employees, contractors, and agents from and against any claims, losses, liabilities, damages, costs, or expenses (including reasonable legal fees) arising from:

  • Your use of the website, products, or services;
  • Your violation of these Terms; or
  • Your violation of any law or third-party rights.

13. Changes to These Terms

We may update or modify these Terms from time to time. The "Last updated" date at the top indicates when changes were last made.

By continuing to use the website or place orders after changes are posted, you agree to the revised Terms. If you do not agree, you must stop using our website and services.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of the Province of Ontario, Canada, and the federal laws of Canada applicable therein, without regard to conflict of law rules.

Any dispute or claim arising out of or relating to these Terms, the website, or our products/services shall be brought exclusively in the courts of the Province of Ontario, and you consent to the jurisdiction of such courts.

You agree to waive any right to a trial by jury to the fullest extent permitted by law.

15. Severability and Entire Agreement

If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.

These Terms, together with our Privacy Policy and any order-specific terms displayed at checkout, constitute the entire agreement between you and anbu Corp. regarding your use of Lakeland Market's website and services.
